Decision on Appeal of request for order to submit documents

Today, Chubu Electric Power Co., Inc. received the Tokyo High Court's decision on its appeal regarding the Shizuoka District Court's order to submit documents. This order is part of case that involves a request for injunction of the operation of the Hamaoka Nuclear Power Station.

The High Court has upheld the Company's appeal.

With regard to this request for injunction on the operation of the Hamaoka Nuclear Power Station, the Company will continue to make every effort to earn the court's understanding concerning the safety of the power station.


Reference: Circumstances leading up to the appeal


  • • January 9, 2004:
    The plaintiffs submitted a request for an order to submit documents, demanding that documents related to application for approval of construction plans in connection with earthquake-resistance design, documents related to records of inspections and testing, and inspection videos be released.
  • • March - August 2004:
    The company voluntarily submitted all documents and videos requested by the plaintiffs, with the exception of those that did not exist and those concerning reactor no. 5 at the Hamaoka Nuclear Power Station, which was not involved in the underlying matter. Personal information and manufacturers' technical information were masked out of the documents submitted.
  • • March 16, 2005:
    A decision by the Shizuoka District Court ordered the company to submit the documents related to application for approval of construction plans with the masking of technical information removed.
  • • March 24, 2005:
    The company lodged an immediate appeal with the Tokyo High Court.
